Welcome to esimbo.com, the official website and associated mobile application (collectively referred to as the "Platform"), operated by ZEBRA PULSE GLOBAL LTD ("we," "us," or "our"). These Terms of Service ("Terms") outline the rules and regulations that govern your access to and use of the Platform. By accessing or using the Platform, you agree to comply with these Terms and our Privacy Policy, which is incorporated by reference.

By using the Platform, you confirm that you have read, understood, and agreed to these Terms. If you do not agree to any part of these Terms, you should discontinue your use of the Platform immediately.

We reserve the right to revise or update these Terms at our discretion. Any changes will take effect immediately upon being posted on the Platform. Users are encouraged to review the Terms regularly to stay informed of any updates. Continued use of the Platform after modifications signifies acceptance of the revised Terms.

Limited License

Subject to compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, and revocable license to access and use the Platform for non-commercial purposes. This license does not grant ownership or rights to any content, features, or services on the Platform.

We retain the right to modify, suspend, or discontinue any portion of the Platform without prior notice. Additionally, we may impose restrictions on certain features or limit your access to portions of the Platform as necessary. Any unauthorized use, reproduction, modification, or redistribution of the Platform or its content, including software, is strictly prohibited unless explicitly permitted within these Terms.

User Responsibilities

The Platform is managed and operated by ZEBRA PULSE GLOBAL LTD from Hong Kong. If you choose to access the Platform from outside Hong Kong, you do so at your own discretion and are solely responsible for complying with applicable laws in your jurisdiction. Any use of the Platform in violation of applicable local laws, including export control laws, is prohibited.

Jurisdiction and Governing Law

These Terms shall be governed and interpreted in accordance with the laws of Hong Kong, without regard to conflict-of-law principles. Any disputes arising from your use of the Platform or these Terms shall be resolved exclusively within the courts of Hong Kong.

Currency and Transactions

For multi-currency transactions, the amount displayed during checkout will be the exact amount charged to your selected payment method and noted on your receipt. Any applicable taxes, fees, or additional charges will be clearly displayed as part of the "Total to Pay" before completing your transaction.

Purchase Policy

Payments for products and services available on the Platform are accepted via Visa and Mastercard credit and debit cards. Transactions conducted through the Platform are governed by the terms and conditions of the respective payment service providers. It is your responsibility to carefully review the user agreement and privacy policy of the payment service provider before making any purchase.

Refunds, where applicable, will be issued back to the original payment method used during the transaction. These terms override any prior agreements or communications, whether verbal or written, regarding the matters outlined here. Modifications or waivers to these terms are only valid if made in writing and signed by an authorized representative of ZEBRA PULSE GLOBAL LTD.

User Commitments and Assurances

By using the Platform, you confirm and agree that:

  1. You are at least 18 years old.
  2. Any content or materials you provide to ZEBRA PULSE GLOBAL LTD for submission or publication on the Platform do not violate any third-party rights, including but not limited to copyrights, trademarks, privacy rights, or intellectual property laws.

Individuals under 18 are not permitted to register or engage in any transactions on the Platform.

Acceptable Use

You are authorized to access, browse, and save one copy of content from this Platform solely for personal, non-commercial purposes. Any reproduction, modification, distribution, or publication of the Platform's content for purposes other than personal use is strictly forbidden unless prior written permission is granted by ZEBRA PULSE GLOBAL LTD.

All content and software featured on the Platform are the exclusive property of ZEBRA PULSE GLOBAL LTD. As a user, it is your obligation to keep a record of your transactions and be familiar with our merchant policies and procedures.

Account Security

If you create an account on the Platform, you are responsible for safeguarding your login credentials, including your password, and ensuring that unauthorized parties cannot access your account. You bear full accountability for any activity that takes place under your account.

ZEBRA PULSE GLOBAL LTD is not liable for any loss or damage resulting from unauthorized access or misuse of your account due to a failure to maintain its security.

Loyalty Program Terms and Conditions

The ESIMBO Rewards initiative is a promotional and loyalty program provided by ESIMBO. Reward credits earned through this program can be used exclusively for purchasing products and services available on the ESIMBO app and website. These credits are offered as a complimentary benefit by ESIMBO and cannot be purchased independently.

Participation in the program is limited to registered users who are signed into their ESIMBO accounts. By logging into the website or app, users are automatically enrolled in the program and agree to abide by its terms.

Reward credits, valued in United States Dollars (USD), are issued for use solely on ESIMBO's platforms. These credits are non-transferable, non-negotiable, and cannot be exchanged for cash.

The accumulation and redemption of reward credits are subject to ESIMBO's established business policies, which may be altered at any time without prior notice. If a user does not make a purchase within 12 months, their reward credits will expire.

ESIMBO reserves the right to revoke rewards, either partially or in full, from specific users or to terminate the entire program at its discretion. All decisions related to the rewards program, including changes to rules or account balances, are final and not open to challenge.

Referral Rewards Program

As part of the ESIMBO Rewards program, the referral rewards initiative encourages existing customers ("Referrers") to invite new users ("Referees") to join ESIMBO. Both parties may qualify for reward credits under this program.

Registered customers who have completed at least one purchase will receive a personalized Referral Code. Reward credits are earned when a new user, with no prior purchase history, registers and completes their first transaction using the Referrer's unique code.

Participation in the referral program is optional, and new users can choose an alternative incentive if they prefer. Referral rewards cannot be combined with other discounts, promotions, or offers.

While a Referrer may invite an unlimited number of new users, rewards credits can only be earned for the first ten (10) successful referrals. For those seeking to conduct larger-scale referral campaigns, ESIMBO offers a dedicated affiliate program.

Referral Codes are valid for one-time use and can only be applied to the first purchase made by a new user. Codes cannot be reused or applied to subsequent transactions, regardless of whether they were utilized during the initial purchase.

ESIMBO retains the authority to remove individuals or groups from the referral program if any misuse, fraud, or unauthorized activity is suspected. Decisions regarding the program, its terms, or eligibility for rewards are final and non-negotiable.

Restriction on Commercial Usage

The ESIMBO platform is strictly for personal, non-commercial use. Activities such as conducting sales or offering services on the platform are strictly prohibited. Any commercial activities, including advertisements, solicitations, or linking to external services, require prior written approval from ZEBRA PULSE GLOBAL LTD.

Violations of this rule may result in penalties, including the removal of prohibited content, suspension of platform access, and potential legal action. Users found engaging in unauthorized commercial use will be permanently barred from the platform.

Intellectual Property Ownership

Although ZEBRA PULSE GLOBAL LTD is not responsible for the accuracy or quality of user-provided content, any compilations of data, text, or other materials made available through its systems (the "Platform Materials") are considered the company's intellectual property. These materials are safeguarded by international intellectual property laws and cannot be reproduced, distributed, or otherwise utilized without prior written approval from ZEBRA PULSE GLOBAL LTD, unless explicitly allowed under these terms.

The Platform Materials and all associated rights belong solely to ZEBRA PULSE GLOBAL LTD. Users are not granted ownership or any rights to these materials except for a limited license provided under the terms. This license does not allow you to use the materials for competing products, resale, or any unauthorized purposes.

No Warranty and Limited Liability

The platform, including all its services, content, products, and materials, is provided by ZEBRA PULSE GLOBAL LTD on an "as is" and "as available" basis. The company makes no guarantees, either explicit or implied, regarding the quality, accuracy, or reliability of the platform, including warranties of fitness for a specific purpose or non-infringement. Additionally, the company does not guarantee that its platform or services are free from harmful elements like viruses.

To the maximum extent allowed by law, ZEBRA PULSE GLOBAL LTD is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform. This includes losses related to data, profits, goodwill, or any other intangible harm. Certain jurisdictions may not allow exclusions or limitations, so some users might have additional protections under applicable law.

Breach of Terms

If ZEBRA PULSE GLOBAL LTD determines that a user has violated these terms, it may terminate their access without notice or take any other necessary action. This could include removing unauthorized content or seeking legal remedies. Users acknowledge that monetary damages may not be sufficient in such cases, and they agree to injunctive or equitable relief. The company may also disclose user information if required by law.

User Responsibility and Indemnification

Users agree to protect and hold harmless ZEBRA PULSE GLOBAL LTD, including its affiliates, employees, and partners, from any claims, damages, or liabilities that arise due to their activities on the platform. This includes any uploaded content, shared links, or breaches of the terms outlined.

Content License Agreement
